Limitation of Liability
The Service Provider's maximum aggregate liability under or in connection with this Agreement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by the Client to the Service Provider under this Agreement in the 12 month period immediately preceding the event giving rise to the liability.
Subject to clause 1, the Service Provider shall not be liable to the Client for any loss of profits, loss of sales or business, loss of agreements or contracts, loss of anticipated savings, loss of or damage to goodwill, loss of use or corruption of software, data or information or any indirect or consequential loss or damage whatsoever.
The Service Provider's liability under this Agreement shall not be limited in respect of any matter for which it would be illegal for the Service Provider to exclude or limit its liability.
